New Delhi: A Delhi court will decide on the Central Bureau of Investigation (CBI) closure report in the Bofors scam on Thursday.
The court will pass the order as to whether the CBI will be allowed to withdraw its prosecution against Ottavio Quattrocchi, the Italian middleman, who has received kickbacks in the infamous Bofors Arms deals, according to the country's top revenue authorities.
The CBI had dismissed the ruling of the Income Tax Appellate Tribunal in the Bofors scam as "nothing new".
The Income Tax Appellate Tribunal had on Tuesday ruled that illegal commissions had been paid to Italian businessman Ottavio Quattrocchi and Win Chaddha in the Bofors scam.
The court will examine whether's CBI's request is malafide.
Supreme Court advocate Ajay Agarwal, who has challenged the CBI move, said the agency wants to let Quattrocchi off the hook.
The CBI had failed on two occasions in its attempt to get Quattrocchi extradited - first from Malaysia in 2003 and then from Argentina in 2007.
In November 2009, the agency had asked the Interpol to take Quattrocchi's name off the Red Corner notice list.
