New Delhi: The Supreme Court will hear the application filed by the State of Tamil Nadu on the Cauvery row seeking convening of a meeting of the Cauvery River Authority on August 17. A Bench comprising Justice D K Jain and Justice Madan B Lokur heard the submissions of senior counsel C S Vaidyanathan, Additional Advocate General Guru Krishnakumar and Umapathy Ganeshan averring that the application was filed for directing the Cauvery River Authority (CRA) of the Government of India.
The application aimed to give effect to and implement the Interim Order dated June 25, 1991 and all subsequent related orders passed by the Cauvery Water Disputes Tribunal (CWDT). The counsel mentioned the matter for urgent hearing.They also told the Bench that CRA should finalise the distress sharing formula for distribution of waters in the river Cauvery at times of distress.
Senior counsel Fali Nariman and Mohan Katarki who represented the State of Karnataka told the Bench that they had no objection to convening a meeting of the CRA. The interim application (IA) filed by the State of Tamil Nadu averred that during the current irrigation year 2012-2013, Karnataka has received 21.9 TMC feet of inflow in its four major reservoirs up to July 20, 2012, but it has not shared the water with Tamil Nadu.
Tamil Nadu sought a direction to Karnataka to release water from its reservoirs during the current year without fully impounding all the flows in its reservoirs on a pro rata basis as per the Order of the Tribunal dated April 3, 1992. It also sought a direction to the Cauvery River Authority of Government of India to perform its statutory obligations by convening its meeting immediately and approve the distress sharing formula evolved by the Cauvery Monitoring Committee for sharing of flows of the river Cauvery.
