New Delhi: The CBI on Tuesday filed an application at the Argentinean Supreme Court in Buenos Aires, challenging the order of an El Dorado court which had last week turned down India's request to hand over the Italian businessman.
Ottavio Quattrocchi was arrested earlier in February in the Argentinean tourist hotspot of Iguazu on the basis of an Interpol Red Corner Notice issued against him in 1997.
The Supreme Court is the only hope left for India in its fight to get Quattrocchi extradition for trial in the Bofors payoff case.
Though the CBI is seeking extradition of Quattrocchi, the process of filing the appeal was done by the Argentine Public Prosecutor, who is representing the agency in the courts.
On Wednesday, Judge Harichi Doi in El Dorado, giving reasons for his last week's judgement, had said the request for extradition was declined because the CBI did not submit the original document of the Interpol Red Corner notice against the businessman issued in 1997.
In 2004, Justice JD Kapoor of the Delhi High Court had dismissed the charges against various accused in the case in connection with the offences punishable under various sections of the IPC including 120B (criminal conspiracy) and various sections of Prevention of Corruption Act were quashed.
The CBI was asked by the court to pursue the charge of conspiracy to cheat against Quattrocchi.
