CHENNAI: Criminal proceedings initiated by the DVAC against the DSP of Namakkal Sub-Division on alleged charges of taking bribe to close a criminal case has been quashed by the Madras High Court. Justice C S Karnan quashed the criminal proceedings, while allowing a criminal revision petition from DSP Srinivasan (now under suspension).According to the DVAC, one K Shanmugham approached Srinivasan to close a criminal case registered against him in connection with a civil dispute for which Srinivasan had demanded a bribe of Rs 1.50 lakh.When part payment of Rs 50,000 was paid through one Subramani at the DSP’s residence, a trap was laid and a case registered against the DSP and Subramani. They were also arrested.The judge said there was no material or corroborative evidence to prove that the petitioner had demanded Rs 1.50 lakh from the complainant to utilise his official power to close a criminal case,since he was not the authorised officer to do so. He was only an immediate superior officer of the investigating officer. He cannot interfere with the enquiry and investigation. Moreover, the complainant and other witnesses have become hostile. As such, the prosecution case had become weak and baseless, the judge said and quashed the proceedings.
