Drunken driving: Delhi court disqualifies man from driving for 6 months

New Delhi: A Delhi court has disqualified a man from holding a driving licence for six months for drunken driving, but reduced his sentence till rising of court for being a first time offender.

"I am disqualifying the convict from holding any driving licence to drive any vehicle of any class or description for a period of six months," Special Judge LK Gaur said, while modifying a magisterial court's order.

The court directed the convict Ram Samajh, a Karawal Nagar resident, to surrender his driving licence before a magisterial court. "The trial judge should also send the particulars thereof to the Licensing Authority in terms of offences under Motor Vehicles Act and direct the concerned Licensing Authority to keep the licence in safe custody," the judge said.

The court reduced the sentence of three days simple imprisonment, awarded to him by the trial court, to till the rising of the court but upheld the fine of Rs 2000 imposed on him.

"After having considered the overall submissions and also the fact that he is a first time offender, I am reducing the sentence of imprisonment imposed for the offence under the MV Act to undergo simple imprisonment for three days to till the rising of the court," the judge said.

Samajh was booked by the police for driving a two-wheeler scooter in an inebriated state and was convicted by the trial court on August 17, 2014. He moved a criminal appeal plea against the magisterial court order for sentencing him for three days simple imprisonment and fine of Rs 2000, despite pleading guilty during the trial.

Samajh had pleaded that he was a first time offender of drunken driving and that he had apologised for his conduct.
