New Delhi: An embarassed Congress on Sunday sought to wash its hands off the PJ Thomas affair contending that the issue of appointment of the CVC was between Government and the Supreme Court.

"Why you are asking Congress. It is not decision of the Congress. Three eminent persons panel decided to appoint him. Why ask the Congress. It is a matter between the Government and the Court", party spokesman Shakeel Ahmed said.

Ahmed faced a volley of questions on the issue a day after Government appeared to have tied itself in knots in the Court on the appointment of Thomas as CVC when.

It told the Apex Court that a corruption case against him was not placed before the three-member panel headed by Prime Minister Manmohan Singh, a claim which has been contested by BJP which termed it as "untruth".

"Who am I to say that (the appointment) is still tenable. It is for the Court and the Government.....The matter is sub-judice. A daily running commentary on what has happened in the Court is neither good for the judiciary nor for justice", he said.

"You are asking me the same question again and again", he said when asked whether the Prime Minister was lying or not lying and as to how the Congress can distance from the matter when the PM, the Home Minister and the then Minister of state in the PMO were involved in the issue.

Initially, when asked whether the Government erred in making the appointment, he said that it was “unwarranted" for the party to comment on the case when the judicial process was on.

Congress sources said that the party would like Thomas to voluntarily resign from the post of CVC.
