CHENNAI: The Madras High Court has rejected a plea from the partners of Albert Theatre at Egmore to quash a cheque bounce case pending against them before a Metropolitan Magistrate at Saidapet, last week.It is for the trial court--IX Metropolitan Magistrate at Saidapet--to look into the issues raised by the partners, Madhukumar and three others, Justice A Arumugasamy said. According to financier Mukanchand Bothra of Sowcarpet, Madhukumar and others borrowed Rs 17 lakh in connection with Rajini starrer Shivaji film in 2007. In part repayment, they issued a cheque for Rs 6 lakh. The cheque, however, bounced when presented for encashment. Bothra lodged a complaint with the IX Metropolitan Magistrate to punish them under Sec 138 of the Negotiable Instruments Act, in 2007.Madhukumar and others approached the High Court seeking to quash the proceedings, on various grounds. Rejecting all the contentions, the judge directed the petitioners to approach the trial court to get findings on the issues raised by them. The judge, however, dispensed with their personal appearance before the magistrate. Except on occasions when the judge required their presence, they need not appear before him, Justice Arumugasamy said, and disposed of the petitions.
