Foster case: HC allows Kohli's extradition to UK
Kohli will face trial in UK in the Hannah Foster rape and murder case.

New Delhi: Maninder Singh Kohli will face trial in UK in the Hannah Foster rape and murder case. The Delhi High Court on Friday allowed extradition of Kohli to UK to face the trial.

"There is sufficient evidence to prove prima-facie case against Kohli. The review petition filed by Kohli has no merit and we dismiss it," PTI quoted a Bench comprising Justice Mukul Mudgal and Justice P K Bhasin as saying.

"The comment made by the British court against Indian government in the case is not justified but the observation cannot lead us to the conclusion that there is a biasness against Asian community," the Bench said, rejecting Kohli's contention that he would not get fair trial in the UK.

The court also said, the Supreme Court order rejecting Kohli's petition does not give him the liberty to file review petition in the High Court.

The Supreme Court had, on July 20, declined to entertain Kohli's petition challenging extradition and directed him to approach the High Court for the review of the order.

A Magistrate's court on June eight had allowed the extradition of Kohli to the United Kingdom. The court, however, had made it clear that no death penalty be awarded to Kohli even after he was found guilty after the trial in United Kingdom.

Kohli is charged with raping and murdering the 17-year-old British girl Hannah Claire Foster on March 13-14, 2003 and then fleeing to India from Britain two days after the victim's body was found.
