Thiruvananthapuram: The CBI court here on Tuesday dismissed a batch of petitions seeking further investigation into the sensational Sister Abhaya case, saying that the earlier investigation by the CBI was not tainted or biased. CBI Judge T S P Moosath, in two different orders, said that there were no circumstances which warranted further investigation. The court made it clear that the issues highlighted in the pleas were earlier probed by the CBI. However, he said that during the course of trial, if it appears that any person not being the accused has committed the offence, then the court can proceed against him.
The pleas for reinvestigation had been filed by former DySP (Crime Branch) K T Michael, Abhaya Action Council convener Jomon Puthenpurackal and Adv P Nagaraj. With regard to Nagaraj’s plea for reinvestigating whether Abhaya had been subjected to rape before her death, the court said that the documents produced by the CBI showed that they had conducted a thorough investigation in this respect.
Jomon had sought further probe into the roles of former Sub-Divisional Magistrate of Kottayam K G Kishore; Crime Branch former Superintendent of Kottayam, K T Michael; Kottayam former DySP, K Samuel; Chief Chemical Examiner R Geetha; Assistant Chemical Examiner M Chithra; Muraleedharan, kitchen staff of Pious Tenth Convent Achamma and Thresiamma and Sister Abhaya’s roommate Sister Sherley for allegedly trying to tamper with the evidence.
