New Delhi: In a setback to Nitish Katara murder accused Vikas Yadav, a Delhi Sessions court on Tuesday dropped two of Yadav’s witnesses from the witnesses' list for their non-appearance in court in the five-year-old case.
Expressing displeasure over their non-appearance in the court, Additional Sessions Judge Ravinder Kaur ordered to drop the witnesses.
Sandeep Mishra, a Ghaziabad-based advocate, and Rambeer Bidhuria, a friend of Vikas, were allegedly seen with Vikas and Vishal Yadav during the period when the police claim they were absconding.
The two failed to appear in the court despite repeated summoning. The court said as the witnesses were cited by the defence, it was incumbent upon them to produce the witnesses on the assigned dates for recording their statements.
Refusing to grant more time to the defence, the court dropped the two from the list of witnesses.
The defence had sought their testimonies to prove that in contrast to the prosecution’s claim that the duo had absconded after the fateful night of February 16-17, 2002, when Katara was murdered, the accused were busy with the election campaigning in Ghaziabad and their presence could be confirmed by these witnesses.
Four defence witnesses have so far been dropped in the case.
