CHENNAI: N Jyothi, counsel for former Deputy Cheif Minister MK Stalin, told the Madras High Court that his client was not very particular to run his MLA office in a building on Circular Road in Kolathur, so long as he is allotted a suitable and convenient place within Kolathur constituency.Based on the submission, Justice V Ramasubramanian on Tuesday held that it would be open to the municipal administration secretary and the Chennai Corporation Commissioner, if they actually decide to establish a school in the land in question on Circular Road, to allot any other alternative building after getting the consent of Stalin and after assessing the convenience and suitability of the place for purpose of running the MLA office.The judge also set aside the orders dated November 8 last year of the municipal administration Secretary cancelling the resolution dated June 29, 2011 of the Chennai Corporation Council as arbitrary and did not satisfy the requirements of Sec 44 of the Chennai City Municipal Corporation Act.As a consequence, the agenda challenged by Stalin and the resolution passed on the same day by the newly constituted council on December 21, 2011 could not stand as they were passed only on the basis of the GO questioned by him, the judge said. The judge was allowing two writ petitions from Stalin seeking to set aside the GO and the resolution.
