New Delhi: A day after being convicted for trespassing and simple hurt under section 323 and 451 of the Indian Penal Code, well known RTI activist Nikhil Dey on Tuesday got bail. He is set to file an appeal against the conviction order. Four others were convicted with Dey.

Calling the verdict shocking and extremely unfortunate, Dey said that such orders were threatening RTI activists to take up causes.

The case dates back to 1998 to a dispute with Pyarelal, the then sarpanch of Harmada, a village near Jaipur, who had been accused by the activists of widespread corruption. The sarpanch was accused of meddling with payments for toilets, homes and other government schemes and cheating actual beneficiaries.

On May 6, Dey and the others went to the village to find out more about the alleged allegations. The activists are said to have Pyarelal’s residence to deliver an official letter, after his office was found closed. The activists were assaulted by the sarpanch, who then filed a case against them for trespassing and hurt.

The case was closed by the police in 1998, but was revived three later by the sarpanch himself. The verdict was announced on Monday.
