Madurai: The Madurai Bench of the Madras High Court on Friday rejected a police plea seeking custody of DMK's Aravakurichi MLA KC Palanisamy, arrested on charges of illegal sand mining, in view of his age.
Justice R Mala also said police custody could not be given automatically without substantial and supporting material.
Palanisamy, 74, has been booked for alleged illegal sand quarrying between December 1, 2009 and May 13, 2011.
Seeking three days' police custody, government pleader submitted custodial interrogation of Palanisamy was required to unearth details such as the purchaser of sand.
The counsel for Palanisamy said police alleged that smuggling had taken place between 2009 and 2011 and asked why the revenue officials did not take any action earlier. He had been implicated now for taking political vendetra he charged.
