The Centre says that the UP government has not issued an appropriate notification for the handing over of the case.

New Delhi: The infighting over Central Bureau of Investigation (CBI) probe into the serial killing of children in Noida continued on Tuesday with the Centre maintaining that the Uttar Pradesh government has not issued an appropriate notification in this matter.

The state government, however, contended that it was still awaiting the Centre's "consent" for a CBI probe and would issue the notification only after receiving that.

Four days after UP Chief Minister Mulyam Singh Yadav announced that he was seeking a CBI probe into the Nithari killings, sources in the government say that all they have received is only a letter from state Principal Secretary (Home) S K Aggarwal to the Union Home Secretary Vinod Kumar Duggal requesting him to order a CBI probe.

The Home Ministry wrote back to the state asking it to issue a notification under section five of Delhi Special Police Establishment Act in a "proper format" and send it to the Department of Personnel and Training at the Centre, official sources said.

The Centre can issue a notification under the Act to commence a CBI enquiry only after the state's notification.

They said until a proper notification was received from the state government concerned, the CBI could not begin its probe as per the law guiding the country's premier probe agency.

Sources in the Union Home Ministry and Department of Personnel said every state had clear guidelines about how to issue a notification for transferring investigation of a crime to the CBI.
