THIRUVANANTHAPURAM: Giving a twist to the Kaviyoor sex scam case, the CBI submitted a crucial report in the CBI court here on Friday stating that Narayanan Namboodiri, father of Anagha, had sexually abused her a few days before the entire family ended their lives.The CBI has based its report not on the DNA test of samples but on a statement given by a friend of the victim as well as circumstantial evidence. A copy of the report obtained by ‘Express’ clearly states that ‘the Chemical Lab, Thiruvananthapuram, has not conducted any DNA test on the samples of semen found on Anagaha’s body as there was no request from the police to do so. The blood samples of Narayanan Namboodiri were not preserved in the Laboratory after the test. Hence, no sample was available for conducting further tests, particularly DNA.’ The report filed by SP Nandakumar Nair further holds Latha Nair guilty under section 306 of the IPC for driving the five-member family to death on the intervening night of September 27 and 28, 2004. The CBI filed the report on the orders of Additional District Judge III, CBI Court, Ernakulam, for further investigation on June 26, 2011 after the court exclaimed whether Latha Nair was responsible for the sexual abuse of Anagha. The chemical analysis report of the vaginal swab of Anagha revealed the presence of human semen and further investigation by Dr Saritha, Assistant Professor, Forensic Department, Medical College, Thiruvananthapuram, who conducted the post-mortem on Anagha’s body, has made it out that sexual intercourse could have been occured between 24 and 72 hours prior to the death. The investigation revealed that all the doors of the house were found locked from inside and the police had to break open them to gain access to the house after the tragedy. ‘The examination of Angha’s friend by the CBI on June 12, 2005, and further examination on November 23, 2011, had confirmed that Narayanan Namboodiri had misbehaved with his daughter. Anagha, who confided to her friend about her father’s strange behavior and her helplessness in revealing the truth to her mother as it was futile as she was an innocent lady,’ says CBI in its report. Further, ‘the circumstantial evidence indicate that prior to the death of Anagha, her family members had not moved out of their house. There was no other male member residing in the house or visited them and in view of the above explained evidence, the only conclusion which can be inferred is that Narayanan Namboodiri has sexually abused Anagaha prior to her death.’ There were two suicide notes, one from the father and the other from the daughter. Both of them had revealed that Latha Nair alone was responsible for their death as the friendship she had with the family defamed them, especially since the woman’s alleged involvement in the Kiliroor sex scandal. Financial liabilities caused through Latha Nair’s association had also haunted the family. The CBI investigation states that the mental pressure, in addition to the shame caused by the publicity through the media about harbouring Latha Nair at their house for a couple of days, forced the family to commit suicide.T P Nanda Kumar, the petitioner in the case, had submitted a list of 30 persons, including CPM leaders Kodiyeri Balakrishnan, M A Baby and P K Sreemathi and Thomas Chandy MLA as well as Bineesh Kodiyeri, son of Kodiyeri Balakrishnan and Ashok Baby, son of M A Baby, warranting an investigation into their alleged involvement in the case.
