HYDERABAD: Justice Nooty Rammohan Rao of the AP High court on Monday stayed the government order made in October 2010 directing the revenue authorities not to register any property of Emaar Properties. The judge made an interim order in favour of Excelsior House Owners Welfare Association which questioned the said government order as one without jurisdiction and being contrary to law. The petitioners' association was formed by persons who purchased plots in an extent of 14 acres of land taken by Emaar for construction of residential flats. The land was given to the builders by the APIIC.The members of the petitioners' association had entered into sale agreements, but could not obtain sale deeds in view of the defence taken by the builders that the government had prohibited execution of the sale deeds.The petitioner pointed out that the property belonged to the APIIC even according to the government at the time of alienation and therefore it could not have made the said order. It also contended that the bonafides of the third party purchasers cannot be faulted because of differences between the government and the APIIC.
