Jharkhand rebel MLAs move SC
Jharkhand's dissident MLAs approached SC seeking restraint from taking up disqualification proceedings against them.

New Delhi: Three independent MLAs from Jharkhand, who were served with disqualification notices by the Assembly Speaker, on Friday moved the Supreme Court seeking to restrain him from taking up action against them.

The move came a day after the Speaker served notices on them for various reasons on separate petitions appealing for their disqualification under the 10th Schedule.

The petition moved by Enos Ekka, Stephen Marandi and Kamlesh Kumar Singh was mentioned by advocate K V Viswanathan before a bench headed by Chief Justice Y K Sabharwal, which decided to hear it on Monday.

The three MLAs have sought a direction to Speaker Inder Singh Namdhari for maintaining status quo with regard to the number of members in the house till the Arjun Munda government proves its majority on the floor of the House.

They have also sought that the Speaker should restrain from dealing in any manner that adjudication proceedings on the pending disqualification proceedings against them.

The MLAs also wanted police protection saying that there was a threat to their lives and that there had been occassions when they were been manhandled after withdrawing support to he NDA alliance.

Inder Singh Namdhari had on Thursday issued notices to the three MLAs on separate petitions seeking their disqualification. He threatened to take ex-parte action against the MLAs if the trio did not appear before his court. "I can take ex-parte decision," he said.

While Enos Ekka and Kamlesh Singh were served the notices for defying the party, Marandi was issued the same for contesting Assembly elections without resigning as a Rajya Sabha member of JMM. The Supreme Court will hear the matter on Monday.
