A single judge at the Madurai Bench of the Madras High Court has directed the principal of Government Law College in Madurai to publish the final semester results of a HIV infected student, whose results were withheld by the college administration.

Karthik (name changed), a HIV infected person, joined the Government Law College, Madurai, in 2006 for a 3-year BL course. Before he joined the college, he was working as a temporary counsellor at the Tamil Nadu Network for People Living with HIV/AIDS and continued his service after obtaining permission from the secretary of the network and the Dean of the Government Rajaji Hospital.

In 2008, the college sent Karthik a notice stating that his admission into the college was irregular and withheld the results of his final semester.

Justice M M Sundresh said, “The post of counsellor is a special post and can only be filled up with a person affected with HIV/AIDS. The court is of the view that the petitioner cannot be equated with any other person who is otherwise gainfully employed,” and dismissed the college’s claims.

“The petitioner showed his bona fides by resigning from the job in 2008”, Justice Sundresh further pointed out while directing the college to publish his results.
