A division bench comprising Justices Elipe Dharma Rao and M Venugopal upheld the action, while dismissing a writ appeal from MRBadrinarayana.The charge against Narayana, a tenant in the flat, was that he had putup an illegal construction in the open reserve area. Being an open reserve space, LN Ramaswamy, the owner of the flat,himself had no right to make use of the reserve land for any other purpose, the bench said.
