Follow us:WhatsappFacebookTwitterTelegram.cls-1{fill:#4d4d4d;}.cls-2{fill:#fff;}Google NewsTaking a serious view of the denial of a post-graduate seat in medicine to a student on frivolous grounds, the High Court has ruled that the student concerned is entitled to compensation, and  directed the NTR University of Health Sciences and the principal secretary (BC welfare) to pay Rs 2 lakh each in compensation to the student within one month.Allowing a plea by Dr M Abdul Amjad Khan from Medak district, justice CV Nagarjuna Reddy directed the NTR University to allot a seat to him during the academic year 2013-14, treating him as a candidate belonging to BC (E).As he had been unjustly denied a seat in MS (ENT) course, he would be entitled to a seat in the said course next year on the basis of the rank he had secured in the entrance test held for admission for 2012-13 without the need for him to again take the entrance examination to be held in 2013.As he had obtained the rank of 2,777 rank in the 2012 entrance test, if he had sufficient merit to choose a seat other than MS (ENT), he shall be allotted such a seat during 2013-14, the judge noted.The petitioner belongs to the Muslim community (Shaik caste) and  obtained MBBS degree from the NTR University of Health Sciences, Vijayawada in 2009. He secured community, nativity and date of birth certificates on May 2, 2011 from the tahsildar, Ramachandrapuram mandal in Medak district.After securing rank in PGCET-2012, he applied for a seat and the verification officer raised an objection to his certificate and he approached the BC welfare department and they informed the university that the competent authority had issued the community certificate.Yet, he was denied the seat in PG course. Then he moved the High Court.Justice Nagarjuna Reddy said the petitioner hadto lose one academic year for no fault of his and held that the fault lay with the verification officer and other authorities of the university.  ``Since disciplinary proceedings have been contemplated against the verification officer, the principal secretary shall also initiate action against him for recovery of Rs  2 lakh.The university is also permitted to recover the compensation amount from the officers who are responsible for not referring the community certificate of the petitioner to the district collector for its re-confirmation/re-verification,’’ the judge said.first published:August 19, 2012, 10:18 ISTlast updated:August 19, 2012, 10:18 IST
