TRAI recommended that the internet service providers cannot be discriminatory in providing internet access as it is an open platform based on the Constitutional right of equality.

The Telecom Regulatory Authority of India on Tuesday came out with its recommendations on net neutrality with non-discrimination by internet providers being the mainstay. TRAI recommended that the internet service providers cannot be discriminatory in providing internet access as it is an open platform based on the Constitutional right of equality.

The report assumes importance because of vehement debates in net neutrality in the past. The recommendations have been forwarded to the ministry of IT and Communication as well. The regulatory body asserted that there should be no intrusion of equal access to the internet to everyone, based on just the content. The regulatory body also said service providers must not enter into agreements with certain agencies when the effect might by discriminatory.

Licensing terms must also detail the list of bias the provider may have in terms of providing content, thus ensuring neutrality. The recommendations also mandated that telecom companies must declare their traffic management activities, and the effects they may have on providing unhindered activity on the internet.
